A Great Falls attorney said Thursday that Town Pump has settled a civil lawsuit filed after static electricity sparked a 2005 fire.
Town Pump sued Misty Rae Hopkins after Cast Gate, Globe, Check Valvesthe fire caused more than $23,000 in damage to Town Pump property. Hopkins then countersued fuel retailer. Town Pump's lawsuit was dismissed in court, according to Hopkins' attorney, Elizabeth Best.

Town Pump paid a $50,000 settlement to resolve Hopkins' counterclaim, Best said.

The fire occurred Feb. 5, 2005, at the Town <Forged Gate, Globe, Check ValvesPump on the corner of 14th Street South and 10th Avenue South in Great Falls. Town Pump claimed that Hopkins got back into her SUV as it was being filled with gas and failed to discharge static electricity before returning to the fuel pump.

When Hopkins reached for the nozzle, a spark ignited fumes around the fuel tank.

Town Pump's suit stated that Hopkins reached for the pump despite signs warning customers not to return to their vehicles, or that they should discharge static electricity before fueling.

The fire engulfed Hopkins' vehicle and damaged the pump Ball Valves ;at;and a canopy at the fueling station.

Another person near the gas pump came to Hopkins' aid. Hopkins' 2-year-old daughter, who was in the vehicle, was rescued and not injured, Best said.
